ORDER : The Court made the following order :- The petitioner/ Accused No.3, who was arrested and remanded to judicial custody on 06.06.2025 for the offence punishable under Sections 191(2), 191(3), 296 (b), 118(1), 109(1), 351(3) of BNS, 2023 in Crime No,122 of 2025 on the file of the respondent police, seeks bail,

2. The case of the prosecution is that on 02.06.2025, the petitioner along with other accused persons have abused the son of the defacto complainant in filthy language and attacked him with stone and threatened him with dire consequences. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that there are totally seven accused persons involved in this case and the petitioner is arrayed as A3. He further submitted that the petitioner along with other accused persons have 2/4

brutally attacked the son of the defacto complainant with stone and caused injuries. He further submitted that the injured person is still in hospital and the investigation is still pending. He further submitted that if the petitioner is released on bail, he may be abscond and tampering the witnesses. Hence, he opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that the injured person is still in hospital and the investigation is still pending. If the petitioner enlarging on bail at this point of time, he may abscond and tampering the witnesses, and also considering the gravity of offence, this Court is not inclined to grant bail to the petitioner.
