This Criminal Original Petition has been filed to quash the First Information Report in Crime No. 381 of 2020 on the file of the first respondent police.

2. When the matter is taken up for hearing today,the learned Government Advocate(Crl.Side) represented that the respondent police has conducted investigation and after investigation since prima facie materials available as against the petitioner they filed final report before the learned Judicial Magistrate No.I,Kulithurai and the same was taken on file in C.C. No.440 of 2020.

3. At this juncture, the learned counsel appearing for the petitioner represented before this Court that the personal appearance of the petitioner before the trial Court may be dispensed with.

4. As far as dispensing with the personal appearance of the petitioner before the trial Court is concerned, it can only be decided by the trial Court on application filed by the petitioner. On such application, the trial Court is directed to consider the same in accordance with law. 2/4

5. Recording the submission made by the learned Government Advocate(Crl.Side) and no materials available before this Court in respect of final report, this Criminal Original Petition stands closed with liberty to the petitioner to challenge the final report. Consequently connected miscellaneous petition is closed.
