For Respondent : Mr.A.Thiruvadi Kumar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 10 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- On a matrimonial dispute, a complaint has been lodged by the defacto complainant as against the petitioners herein and apprehending arrest at the hands of the respondent police for the offence under Sections 498A, 294b, 323, 354, 506(i) IPC in Crime No.10 of 2021, the petitioners have filed this application for anticipatory bail.

2.By order dated 09.09.2021, the earlier petition filed by the petitioners seeking anticipatory bail was dismissed on the ground that though the petitioners obtained interim anticipatory bail by submitting that they would co-operate with the counselling conducted by the respondent police, they have failed to honour the same. The learned counsel appearing for the petitioner prayed for referring the matter to the Mediation Centre.

CRL OP(MD). No.14784 of 2021 3.Considering the above submission, the matter is referred to Mediation and directed the parties to appear before the Mediator, on the said date.

4.Today, the Additional Public Prosecutor, on instructions, submitted that the petitioners are not cooperating for the enquiry and they neither appeared before the respondent police nor appeared before the Mediator.

5.Having obtained an interim order of protection as against the arrest, the petitioners failed to co-operate for the enquiry and failed to appear before the respondent police and / or the Mediator. In view of the conduct and attitude of the petitioners, this Court is not inclined to entertain this application and the same is accordingly, dismissed.
