ORDER

This writ petition has been filed by a retired employee of the respondent Transport Corporation, seeking a Mandamus to direct the respondents to disburse the difference amount of Gratuity, Earned Leave and Surrender Leave Salary along with 6% interest on the basis of 7th Pay Commission.

2. A perusal of the records indicates that the petitioner had attained superannuation on 28.02.2018. The 7th Pay Commission came into force on 01.01.2016 itself. However, it was implemented only on 01.04.2018. The petitioner's terminal benefits were released based on the 6th Pay Commission benefits. Hence, the petitioner has sent a representation to the respondents on 16.06.2025, seeking to pay the difference in the monetary benefits. Since no action has been taken, the petitioner is constrained to approach this Court by way of filing the present writ petition.

3. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents.

4. Considering the above said facts, the respondents herein are directed to disburse the eligible amount to the writ petitioner based upon the 7th Pay Commission benefits along with interest at the rate of 6% per annum, from the due date, till the date of disbursement, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above said directions, this Writ Petition stands disposed of. There shall be no order as to costs.
