ORDER
This writ petition is filed with the prayer to consider the representation of the petitioner dated 29.07.2024 and 14.11.2025 and to direct the respondents to lay a road in Survey Nos. 1559/1E, 1559/4A2, 1559/5B, 1559/6B, 1559/7B, 1559/8B, 1559/9B in Vallliyoor Village, Radhapuram Taluk, Tirunelveli District.
2.The learned counsel for the petitioner would submit that earlier when the lands were declared as road portion, the petitioner accepting the same, is at least praying that as claimed the road be laid. The same is not considered till date and therefore, the petitioner is before this Court.
3.When the matter came up for hearing, the learned Government Standing Counsel would submit that considering of the prayer would depend upon firstly the nature of survey numbers, if the survey numbers are already treated as road then the road can be formed. Secondly, even if it is a road, the same will be laid depending upon the allocation of funds and approval of the project by the Government on priority basis. Therefore, the petitioner's representation will be accordingly considered. 4.In view of the submissions made by the learned Government Standing Counsel, the petitioner's representation dated 29.07.2024 and 14.11.
2025 shall be taken up for consideration by the 4th respondent as submitted and whether the survey numbers in question are form part of the public road or not, shall be considered and secondly, the necessity can be assessed and due report can be made to the third respondent and the 1st and 2nd respondents for sanctioning of funds. If they decide to lay the road, the fourth respondent shall take up the enquiry and pass an order within a period of three months from the date of receipt other web copy of the order and intimate the result to the 4th respondent. It will be open for the petitioner to place all the supporting documents with reference to the classification of the survey numbers as road and and also about the necessity for laying down the road.
5.With the above observation, this Writ Petition stands disposed of. No costs.
