ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorari, to quash the refusal check slip dated 12.06.2025 on the file of the respondent.

2. The respondent has refused to register the sale deed citing Section 22A(2) of the Registration Act.

3. On perusal of the document, it is seen that the petitioner originally owned 21 cents of land, out of which he has sold 4 cents. The petitioner now intends to sell the remaining 17 cents. Further, it is seen that on the eastern side, there is a north-south pathway, and on the northern side, there is a 13 feet gap between two individuals' properties. Additionally, the remaining 21 cents in the said survey number belongs to one Jegannathan, who has also intended to sell.

4. The above narration of facts clearly indicates that no layout has been formed. Hence, there is no new layout, and the application of Section 22A(2) of the Registration Act appears to be inappropriate. Therefore, the impugned order has been passed without proper application of mind.

5. Therefore, the impugned refusal check slip dated 12.06.2025 is hereby quashed. The respondent is directed to register the sale deed within a period of four weeks from the date of receipt of a copy of the order. 2/4

6. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
