.. Respondents Prayer :Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus, to direct the respondents herein to secure and produce the body or person of the detenue namely Karthick, S/o.Pandi, aged about 30 years, before this Court and set him at liberty.

ORDER

(Order of the Court was made by N. ANAND VENKATESH,J.) This Habeas Corpus Petition has been filed for a direction to the respondents to secure and produce the person or body of the detenue, who is the husband of the petitioner and to set him at liberty.

2. Heard the learned counsel for the petitioner and the learned Counsel for State of TN (Crl.Side) appearing on behalf of the respondents.

3. The petitioner's husband went missing from 17.03.2026 and inspite of best efforts, his whereabouts were not able to be ascertained. Hence, a complaint came to be given before the second respondent, based on which, a ''man missing'' FIR was registered in Crime No.167 of 2026. Since no effective steps were taken by the second respondent to find the whereabouts of the petitioner's husband, the present Habeas Corpus Petition has been filed before this Court.

The learned Counsel for State of TN (Crl.Side), on instructions, submitted that there is a matrimonial dispute between the petitioner and her husband and that, even on an earlier occasion, he had gone out of the matrimonial home and a complaint came to be given, based on which, an enquiry was conducted and thereafter, the petitioner's husband rejoined the petitioner. Once again, he has gone out of the matrimonial home only due to the matrimonial dispute.

5. Taking into consideration the facts and circumstances of the case and based on the submissions made on either side, there shall be a direction to the second respondent to proceed with the further investigation in the pending FIR in Crime No.167 of 2026 in line with the guidelines issued by this Court in K.Sukumari vs. The Superintendent of Police, Virudhunagar District, Virudhunagar and others, reported in [2018 (2) LW (Crl) 636].

6. This Habeas Corpus Petition is disposed of with the above direction.
