Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 and 2 to conduct department enquiry on petitioner's representation against the third respondent dated 20.07.2022.

ORDER

On the basis of the certain allegations against the third respondent, the petitioner had made a representation on 20.07.2022, which came to be received by the first and second respondents on 29.07.2022. The petitioner now seeks for a direction to the respondents to consider his representation. Apparently, the petitioner's representation was received by the respondents 1 and 2 for about 10 days back and during this short time, this Court would not be justified in directing them to consider the representation. Further more, non-consideration of representation by a Government official within 10 days, particularly on a complaint of this nature, may not amount to dereliction of their duties. Since the petitioner had hastily approached this Court with a prayer for consideration, I am not inclined to interfere with such prayer. However, if the petitioner is of the view that his representation has not been considered even after an inordinate delay, liberty is hereby granted to the petitioner to file a fresh writ petition with the same prayer.

3. With the above liberty, the Writ Petition stands dismissed. There shall be no order as to costs.
