Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the impugned order of the 1st respondent in Na.Ka.No.7328/2015/sapa dated 27.01.2016 and quash the same in respect of denying 12% interest for gratuity from the date of retirement of the petitioner i.e. on 31.12.2011 on the basis of G.O.Ms.No.173 dated 01.04.2004, Finance (Pension) Department, pending salary for a sum of Rs.1,09,846.50 (from April 2006, (September, 2006 to July 2008) and provident arrears (Arrears of salary difference from the month of April 2008 to March 2010 merged with the provident fund) for a sum of Rs.73,504/- and consequently directing the 2nd respondent to pay the monetary benefits with interest for delayed payment forthwith to the petitioner.
