The petitioner viz., D.Jagatheesh, R.Maheswari and B.Manjari in W.P.(MD).NO.7012 of 2019 all three persons participated in the selection process conducted by the second respondent for the post of Secondary Grade Teacher in Kallar Reclamation School and their names also included in the provisional list dated 17.10. since the order has not been issued Udhaya in Writ Petition in W.P.No.1731 and this Court granted blank interim order for stalling the entire selection process and subsequently, this Court vacated the interim order granted in favour of the Udaya rani in 1745 of 2014 and issued a direction to ketp one vacant instead Udha and filled up the remaining post. However, subsequently, one Jegadeesh and Maheswari has given appointment. However, the petitioner was not given appointment. Therefore, the contempt Petition has been filed.

2.The learned counsel appearing for the petitioner would submit that though totally 64 posts for recruitment was filled up by virtue of 1/4

the interim order. The said post was not filled up and subsequently 49 posts were filled up and remaining 15 posts are kept vacant and subsequently, based on the order passed by this Court remaining 14 posts were filled up and now only one post available for the petitioner, Manjari and Udaya and one Jeevitha fighting for the .. In view of the above, one post is not filled up because of three persons fighting for the . Hence, the order was not complied letter and spirit.

The learned counsel for the petitioner would submit that this Court may issue a direction to the Recruitment Board to fill up the said post through eligible persons, as per the Teacher Recruitment Selection Process dated .

In view of the above, there is no wilful disobedience on the part of the respondent. Hence, the contempt Petition is closed by issuing direction to the Board to fill up the said post to give appointment to the eligible person as per the TRB rank as per the The contempt petition is subject to the result of the appeal pending before the Division Bench of this Court.
