For Petitioner : Mr.B.Anandan For Respondent : Mr.SS.Madhavan Government Advocate (Crl.side) O RDER This petition is filed seeking for a direction to the learned Judicial Magistrate, Pattukkottai to expedite the trial in CC.No.91 of 2017. 1/4
2.It is submitted by the learned counsel for the petitioner that in the year 1995, a case has been registered against 8 accused including the petitioner and subsequently, after the filing of the charge sheet, the case has been taken on file in the year 1996. During the course of trial, two accused died ie., A2 and A6 and the accused No.1 was absconding, thereby the case is pending since long time. The case against the accused No.1 was split up and the case is being proceeded against the other accused. Now, ultimately the case is numbered as C.C.No.91 of 2017 against the petitioner/A3 and the accused Nos.1 and 8. Since the case is pending from 1995, the petitioner sought for a direction to the concerned Court to expedite the trial in C.C.No.91 of 2017 and dispose of the same within the time frame fixed by this Court.
3.The learned Government Advocate (Crl.side) on the other hand submits that the accused Nos.1, 3 and 8 are now available for trial and the prosecution is also ready to produce 8 witnesses. The same is recorded. 2/4
4.On hearing the submissions made by the learned counsel for the petitioner as well as the learned Government Advocate (Crl.side) and on going through the records, the learned Judicial Magistrate, Pattukkottai is directed to dispose of C.C.No.91 of 2017 within a period of four months from the date of receipt of a copy of this order. The prosecution is directed to cooperate and produce the witnesses before the Court.
