PRAYER :- For Bail in Crime No.8 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded to judicial custody on 06.01.2023 in Crime No.8 of 2023 for the offence under Sections 8(c) r/w. 20(b)(ii)(B), 22(c), 29(1) of NDPS Act, in crime No.8 of 2023, on the file of the respondent police seeks bail.
2. The case of the prosecution is that based on the secret information, the 1/3
respondent police intercepted the petitioner and the other accused, at that time, they were found in illegal possession of 1.100 Kgs of Ganja and 100 grams Mushroom. Thereafter, the further process were undertaken and the petitioner was arrested and remanded to judicial custody. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the entire contraband was recovered from the first accused and no recovery has been made from this petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent police submitted that no previous case is pending against this petitioner. He further submitted that the petitioner has not given proper reason for his presences in the place of occurrence.
5. Considering the gravity of offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
