This Writ Petition has been filed seeking for a direction to the second respondent to accept the one time settlement amount paid by the petitioner in connection with the loan and return the original documents to the petitioner.

2. Since the present Writ Petition has been filed as against the private Bank, it cannot be maintained within the domain of writ jurisdiction under Article 226 of the Constitution of India as the private Bank is not entrusted with the public duty.

3. In view of the above, this Writ Petition is dismissed. There shall be no order as to costs.
