PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying this Court to call for the records in FIR in Crime No.121 of 2012 dated 07.10.2012 pending on the file of the first respondent upon the file of the first respondent upon the complaint of the second respondent for alleged commissioner of offences under Section 147 of IPC and Section 3 of PPDL Act and quash the same. ORDER

This petition is filed to quash the FIR in Crime No.121 of 2012 dated 1/4

07.10.2012 on the file of the first respondent. 2.On the side of the prosecution, it is stated that a chargesheet was filed and the same was taken on file as P.R.C.No.3 of 2022 before the learned Judicial Magistrate, Thiruvadanai. The case is posted on 08.06.2023 for NBW pending against A2, A8 and A11. Totally 12 accused are involved. 3.In view of the submission made by the prosecution and the chargesheet was already filed, this Criminal Original Petition is dismissed as infructuous with the direction to the learned Judicial Magistrate to split up against the accused against whom NBW is pending and to proceed with the committal proceedings within a period of three months from the date of receipt of copy of this order. Consequently, connected miscellaneous petition is closed. The Registry is directed to send the copy of the order to the concerned Judicial Magistrate.
