For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C.

PRAYER :- To enlarge the petitioner on bail in C.C.No. 161 of 2024 on the file of the Learned Additional District for Principal Special Court for EC and NDPS Act cases, Madurai in Crime No.15 of 2023 on the file of the Respondent police. 1/3

ORDER : The Court made the following order :- The petitioner/A7, who is facing a case for the offence under Sections 8(c) r/w 20(b) (ii)(C), 25, 29(1) of Narcotic Drug & Psychotropic Substances Act, 1985, in C.C.No. 161 of 2024 on the file of the Learned Additional District for Principal Special Court for EC and NDPS Act cases, Madurai, in crime No.15 of 2023 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner and the other accused were found in possession of 21.600 kg of ganja. Hence, the case. 3.Considering the fact that the quantity involved in this case is commercial quantity and also considering the fact that there are CDR particulars of phone contact and the banking details with reference to the financial transaction also, I am not inclined to accept the argument of the learned counsel for the petitioner that there are no materials against the petitioner except the confession of the co-accused.

4. Further, the learned counsel for the petitioner would vehemently rely upon the earlier order of this Court releasing the accused No.5 on condition. It is now said that the accused No.5 is also absconding and Non Bailable Warrant was issued against him.
