PRAYER :- for Anticipatory bail in Crime No.130 of 2019 on the file of the respondent police ORDER : The Court Made the following order :- The petitioners are figuring as A1 and A2 in Crime No.130 of 2019, on the file of T.Kallupatti Police Station. Initially, the case was registered under Section 174 of Cr.P.C. Nevertheless, the names of these petitioners have been implicated even at the very outset. The deceased was one Kumar, who was working in the quarry run by the petitioners herein. The said Kumar is said to have given information to the authorities about the illegal quarrying activities said to have been indulged in by the petitioners herein. The said Kumar was done to death on 02.07.
2019 and then, his body was laid on the road to make it appears as if it was a case of accidental death. The persons who are said to have perpetrated the crime have been named as A5 to A8. They have since been arrested and based on their confession, the involvement of the petitioners https://hcservices.ecourts.gov.
CRL OP(MD). No.11593 of 2019 has come to light.Subsequently, the police have also filed alteration report.
2.The petitioners herein had earlier filed a petition for antipatory bail but the same was dismissed as withdrawn on 02.08.2019.
The learned Senior Counsel appearing for the petitioners would contend that since Petchiammal was not arrested and this Court was of the view that the earlier criminal original petition has been filed prematurely, he chose to withdraw that petition. I am not persuaded by the said submission. This is a case of murder. The petitioners are quarry owners. They are said to have instigated A5 to A8 to commit the murder in question. This is a matter in which the custodial interrogation of the petitioners is very much warranted. Therefore, I do not find any ground to grant the relief and the criminal original petition stands dismissed.
