PRAYER: Contempt Petition filed under Section 11 of Contempt of Courts Act, to punish the respondents herein for their willful deliberately disobedience of the order passed by this Court in W.P. (MD)No.18812 of 2018 dated 29.08.2018.

Prayer in WP(MD). 18812/ 2018 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus directing the respondents to settle the petitioners retirement benefits including Provident Fund, Gratuity, IRT Share amount, Earned Leave Wages, Commutation of the Pension and monthly pension payable to him with reasonable rate of interest within the time that may be stipulated by this Honble Court.

O R D E R

The present Contempt Petition has been filed alleging non compliance of the order dated 29.08.2018 made in W.P.(MD) No.18812 of 2018.

2. The learned Standing Counsel for State appearing for the respondents has produced a copy of the order passed by this Court in Rev.Aplw.(MD)No.161 of 2019, dated 18.02.2020, wherein, this Court https://hcservices.ecourts.gov.in/hcservices/ 1/2

Cont.P.(MD) No.1218 of 2019 allowed the review application and restored the writ petition in W.P.(MD)No.18812 of 2018. The learned counsel for the petitioner also endorsed the submission made by the learned counsel for the respondents.

3. In view of the order passed by this Court in Rev.Aplw.(MD) no.161 of 2019, nothing survives in this Contempt Petition. Hence, this Contempt Petition is closed. Both parties can agitate their rights in the Writ Petition.
