Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondent to consider the petitioners appeal dated 23.02.2015. For Petitioner : Mr.V.Karuna For Respondent : Mr.C.Selvaraj, Special Government Pleader

ORDER

The petitioner seeks for disposal of his appeal dated 23.02.2015 filed before the respondent arising out of a patta proceedings.

2.The grievance of the petitioner is that the said appeal is still pending without passing the final order. Needless to say that the appellate authority has to consider the appeal on its own merits and in accordance with law and pass orders, after hearing the rival parties.

3.Learned Government Advocate brought to the notice of this Court that as early as on 07.03.2015, the petitioner was directed to furnish certain documents and if those documents are furnished, the appeal can be disposed of at an early date. 4.Accordingly, this writ petition is disposed of by directing the petitioner to furnish the documents sought for by the appellate authority without loss of further time, in any event, within a period of three weeks from the date of receipt of a copy of this order, if those documents are not furnished already. On receipt of such documents, or if the documents are already received by the appellate authority, namely, the respondent herein, the appeal shall be disposed of within a period of twelve weeks thereafter. It is made clear that this Court has not expressed any view on the claim made by the petitioner. No costs.
