[Order of the Court was made by K.KALYANASUNDARAM, J.] The Habeas Corpus Petition has been filed seeking a direction to the respondents 1 and 2 to produce the petitioner's daughter, namely, M.Kanishka, aged about 18 years before this Court and set her at liberty.
2.According to the petitioner, the detenue is studying B.Sc., (Nursing) II year at Namakkal. On 14.11.2020, she had gone to their relatives' house, but subsequently, she did not come back home. On verification, the petitioner came to know that the third respondent abducted her daughter illegally without her willingness. Hence, he https://hcservices.ecourts.gov.in/hcservices/ 1/2
H.C.P.(MD) No.1148 of 2020 preferred a complaint before the second respondent on 17.11.2020. But no appropriate action was taken to secure the detenue. Hence, the present petition has been filed.
3.When the matter is taken up for hearing today, the petitioner, the detenue and the parents of the third respondent appeared before this Court through video conferencing from the Public Prosecutor's Office. On enquiry, the detenue would state that she is having love affair with the third respondent and she is staying in his house. She also stated that she is not willing to go with the petitioner.
