ORDER : The Court made the following order :- The petitioner/Sole Accused, apprehending arrest at the hands of the respondent Police for the alleged offence punishable under Sections 67 of IT Act, 2000, in Crime 100 of 2019 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner had posted some obscene messages against the defacto complainant in social media (ie) Whatsapp for not 1/3

paying loan amount. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and is no way connected in this case. Originally, the eptitioner was granted anticipatory bail on 01.03.2022 in Cr.M.P. No.385 of 2022 by the Sessions Court, Karur with some conditions. Due to some health issues, the petitioner was unable to comply the above said conditions.

4. The learned Government Advocate (Crl. Side) would submit that the petitioner is having four previous cases, among which, one is similar in nature in Crime No.52 of 2023.

5. Considering the facts and circumstances of this case and considering the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. He has to go for custodial interrogation, since the learned Government Advocate (Crl. Side) submitted that so far the above said mobile has not been recovered.
