ORDER

(Order of the Court was made by the Hon'ble G.R.SWAMINATHAN J.) One Chandrababu filed W.P.(MD)No.6054 of 2010 challenging the conditional order of attachment made under Section 167 of the Tamil Nadu Co-operative Societies Act. The writ petition was dismissed as not maintainable on 15.11.2011. 1/3

During his life time, Chandra Babu did not file any writ appeal. He passed away in the year 2022. His daughter wanted to deal with the property. Only then she claims that she became aware of the order of attachment. Hence, this writ appeal has been filed in the process there has been a delay of 4227 days in preferring the same. The delay is inordinate. In any event, it is not for the present appellant to offer any sufficient cause. It was Chadrababu who should have offered sufficient cause to explain the delay in filing the writ appeal.

2. Looked at from any angle, inordinate delay cannot be condoned. The Civil Miscellaneous Petition stands dismissed. The writ appeal is dismissed at the SR stage.
