Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondent herein to consider and pass orders on the petitioner's representation dated 24.03.2025 by permitting the petitioner's stage carriage bus TN-68-A-4599 to make use of Kumbakonam New Bus Stand in terms of Section 72 (2) XXII of MV Act 1988 r/w Rule 245 (i) of TNMV Rules, 1989, while plying on the route Orathanadu to Kumbakonam forthwith.

ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner and learned Government Advocate for the respondents.

2. The petitioner is plying a Stage Carriage Town Bus between Orathanadu and Kumbakonam, via Kumbakonam New Bus Stand.

3. It is the case of the petitioner that frequently passengers are requesting the bus to stop at Kumbakonam New Bus Stand. However, in the absence of proper permit and non-stopping the bus on the Kumbakonam New Bus Stand, the petitioner is unable to stop the bus at Kumbakonam New Bus Stand, despite the demands from the passengers.

4. Under these circumstances, the petitioner has given an application on 2/4

24.03.2025 with the request to the respondents to exercise their power under Rule 245(i) of the Tamil Nadu Motor Vehicles Rules, 1989 and Section 72(2) XXII of the Motor Vehicles Act, 1988.

5. The learned Government Advocate for the respondents submits that the petitioner's representation, dated 24.03.2025 will be considered and disposed of on merits.

6. Recording the above submissions, this Writ Petition is disposed of by directing the respondents to pass appropriate order on the aforesaid representation of the petitioner as expeditiously as possible preferably within a period of four (4) weeks from the date of receipt of a copy of this order.

7. Needless to state, before passing such order, the persons, who are likely to be impacted by the such decision, shall also be heard.
