After hearing when this Court about to dismiss the writ appeal on merits, learned counsel for the appellant would submit that the appellant will approach the civil court and establish his right. However, he seeks a direction that the Civil Court shall not be influenced by any of the observations made in the impugned order of the learned Single Judge.

2. Recording the above submission, this Writ Appeal is dismissed. If the appellant approaches the Civil Court, the Civil Court shall decide the case independently on its own merits and shall not be influenced by 2/4
