PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, directing the learned Judicial Magistrate No.II, Kuzhithurai, to take on file the Crl.M.P.Sr.No.3403 of 2022 within a time frame that may be fixed by this Court.

O RDER This petition has been filed seeking for a direction to the learned Judicial Magistrate No.II, Kuzhithurai, to take the case in Crl.M.P.Sr.No.3403 of 2022 on file within a time frame that may be fixed by this Court.

2. The learned counsel appearing for the petitioner would submit that the petitioner has filed a protest petition before the trial Court and the same was returned again and again. Hence, the petitioner has filed this petition to take the case on file before the trial Court.

3. The Government Advocate (Criminal Side) appearing for the respondent Police would submit that the respondent Police has already filed a closure report before the trial Court on 13.08.2021.

4. In view of the above, the Criminal Original Petition stands disposed of. Liberty is granted to the petitioner to work out his remedy in the manner known to law.

5. At this juncture, the learned Government Advocate (Criminal Side) appearing for the respondent Police would submit that for signature purpose, the RC was returned to the respondent Police and it will be resubmitted within a period of one week and on such resubmission, the trial Court is directed to proceed in accordance with law.
