PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Certorarified Mandamus, call of the records pertaining to the impugned order passed by the 2nd respondent in Na.Ka.No.28/G4PS/2025 dated 17.05.2025 and quash the same and directing the respondents to grant necessary permission and provide adequate police protection for conducting the 1/5

demonstration by the petitioner's party namely, Tamil Nadu Makkal Viduthalai Eyakkam, scheduled to be held on 02.07.2025 at 10.00 a.mat Mukkoottusalai, Mudukkur, Thanjavur District, based on the representation, dated 02.05.2025.

O R D E R

The petitioner has made a request for conducting demonstration on 06.05.2025 at Mukkoottusalai, Mudukkur, Thanjavur District, based on his representation, dated 02.05.2025, that the respondent police has not conducted the investigation in Crime No.162 of 2025 in a proper manner. The respondent police has rejected the request of this petitioner, by his order in Na.Ka.No. 28/G4PS/2025 dated 17.05.2025. Aggrieved over the same, the petitioner is before this Court.

2.In the event, if the respondent police has not conducted the investigation in a proper manner, the 2/5

petitioner/defacto complainant is having a remedy before this Court as well as before the Magistrate Court. Instead of invoking the available remedy, this petitioner is attempting to show his strength by conducting a protest. This Court is of the view that the respondent police has rightly rejected the request of this petitioner for conducting a demonstration and therefore, this Court is not inclined to interfere with the order of the respondent police. 3.Investigation is a process of finding out the truth and the respondent police are duty bound to conduct the investigation without giving any room for suspicion in the process of investigation. With the hope that the investigation in Crime No.162 of 2025 would be conducted in a proper manner, this writ petition is disposed of. No costs.
