(Order of the Court was delivered by G.R.Swaminathan, J.) Heard both sides.

2.The petitioner challenges the impugned eviction notice issued by the second respondent. The petitioner belongs to scheduled caste. In Survey No.424/18, as many as 46 plots have been assigned in favour of the members of the scheduled caste. The petitioner is one such allottee. The petitioner's categorical assertion is that she is not an encroacher, but the private respondents herein are the actual encroachers. This position is conceded by the learned Government Advocate.

3.It is seen that the impugned communication issued to the writ petitioner has also been withdrawn. Thus, the petitioner has now been cleared of the taint of an encroacher. But then, we direct the second respondent to take action against the actual encroachers. 4.With the aforesaid direction, this writ petition is disposed of. No costs.
