Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to impugned order passed by the 1st respondent in Lr. No.SE/TEDC/TTN/DFC/AO/REV/AAO/HT/AS.2/F. 274/D.1031/26 dated 03.06.2026 and quash the same as illegal and consequently direct the respondents to permit the petitioner to pay the outstanding CC dues pertaining to the Electricity Service Connection No. HTSC No.274 in ten installments and to restore the electricity service connection based on the petitioners representation dated 27.05.2026. ORDER
The petitioner assails the communication dated 03.06.2026 issued by the first respondent, whereby the request of the petitioner to pay the consumption charges for the period from December 2025 to January 2026 in monthly instalments has been rejected. The petitioner is due a sum of Rs.10,35,712/-, inclusive of belated payment surcharges.
2. The petitioner pleads inability to pay the said amount in a lump sum, citing financial constraints, and undertakes to pay 40% of the amount due within one week from today and the balance amount in eight equal monthly instalments.
3. Learned Standing Counsel appearing for the respondents submitted that there is no provision for payment of arrears of consumption charges, including belated payment surcharges, in instalments and that electricity supply would be restored only upon payment of the entire amount due.
4. The petitioner has shown bona fides in undertaking to clear the entire outstanding amount in instalments. No prejudice would be caused to the respondents if the petitioner is permitted to pay 40% of the amount due initially and the balance amount in eight equal monthly instalments.
5. In light of the above, the Writ Petition is disposed of directing the petitioner to pay 40% of the outstanding amount within one week from
today and the balance amount in eight monthly instalments. Upon deposit of 40% of the outstanding amount, the respondents shall restore the electricity service connection to the petitioner's ice plant, namely, "R.V. Ice Plant".
6. In the event of default in payment of any monthly instalment, the respondents are at liberty to take action as permissible in law. 7.There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
