ORDER

The learned counsel for the petitioner herein brought to the notice of this Court that earlier 20% of the cheque amount was credited to the file of STC.No.227 of 2023 on the file of the learned Judicial 1/4

Magistrate(FTC)(ML), Uthamapalayam. The matter was settled by way of mediation in which Rs.8,00,000/- was already settled by the petitioner herein. The total cheque amount being Rs.10,00,000/-, the petitioner ought to have been permitted by this Court to receive an amount of Rs. 2,00,000/- which has already been credited to the account of STC.No.227 of 2023 before the learned Judicial Magistrate(FTC)(ML), Uthamapalayam. Since the same is not addressed in the order passed by this Court on 02.07.2025, the matter is brought up before this Court again as being mentioned.

2. Heard either sides.

3. Recording the no objection of the respondent herein, the petitioner herein is permitted to file a suitable application before the learned Judicial Magistrate(FTC)(ML), Uthamapalayam in STC.No.227 of 2023 for receipt of the amount which was credited by the petitioner herein.
