ORDER

This criminal original petition has been filed seeking a direction to withdraw and transfer the case in M.C.No. 22 of 2017, on the file of the learned Judicial Magistrate, Devakottai to the file of the learned Judicial Magistrate No. 1, Kovilpatti or any other competent court in Thoothukudi. 2.The learned Counsel appearing for the petitioner submitted that there is a life threat to the petitioner. Therefore, he wants to transfer the case in M.C.No. 22 of 2017, on the file of the learned Judicial Magistrate, Devakottai to the file of the learned Judicial Magistrate No. 1, Kovilpatti or any other Court.

3.I have considered the submission made by the learned Counsel appearing for the petitioner.

4.On a perusal of records, it is seen that the petitioner is the husband of the first respondent and father of the second respondent. They got married in the year 2013 and due to difference of opinion, they are living separately. The first respondent filed a petition in M.C.No.22/2017, before the learned 2/4

Judicial Magistrate, Devakottai, claiming maintenance of Rs.15,000/- (each) from the petitioner. and the same is pending for trial. 5.On a perusal of the affidavit, I find no substantial material to show that the petitioner is having a life threat. Hence, this criminal original petition stands dismissed.
