ORDER
This petition has been filed seeking amendment of the plaint in O.S. No. 27 of 2008 on the file of the Sub Court, Sivaganga, which is the subject matter of the Second Appeal in S.A.(MD) No. 185 of 2021 pending on the file of this Court.
2. The suit is one for partition and the present application has been taken out pending the Second Appeal in order to give quietus to the 1/2 https://www.mhc.tn.gov.in/judis
CMP(MD). No.7079 of 2026 disputes between the parties and also to ensure that no technical objections are raised against the appellant in the Second Appeal.
3. The learned counsel appearing for the contesting respondent has no serious objection to the amendment petition being allowed. He would further submit that, at this stage, the parties may accept that each of them is entitled to a 50% share in the suit property and, if some accommodation is shown, they may also work out the mode of actual division. Failing such settlement, at least the preliminary decree can be confirmed.
4. In view of the above, this CMP is allowed. The learned counsel for the plaintiff/appellant is permitted to carry out the necessary amendments in the plaint and file a clean copy before this Court on or before 23.06.2026.
5. Post the matter on 23.06.2026 for reporting settlement or for further orders.
