ORDER : The Court made the following order :- The petitioner/Accused herein, who was arrested on 16.05.2023, for the alleged offence under Sections 294(b), 450, 297, 506(ii) IPC, Section 3(i) TNPPDL (Prevention of Damage and Loss) Act, in Crime No.76 of 2023, on the file of the respondent Police seeks bail.

2.This is the third bail petition filed by the petitioner/A5. The earlier bail petitions filed by the petitioner was dimissed by this Court on 14.06.2023 and 20.06.2023. Since the co-accused/A6 has been released on bail, this petition was filed by the petitioner.

3.The learned Additional Public Prosecutor would submit that the coaccused/A6 was enlarged on bail only on considering the overt act committed by him. In this case, the property has not been recovered so far and the investigation is not yet completed. Hence, prays to dismiss the petition. 4.Though the co-accused has been enlarged on bail and this is the third petition for bail, considering the manner in which the occurrence took place, nascent stage of investigation and the non-recovery of property, this Court is not in a position to accept the grounds raised by the petitioner. Considering the above facts and the vehement objection raised by the learned Additional Public Prosecutor, this Court is not inclined to enlarge him on bail.
