Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to direct the respondents 2 and 3 to restore the original EMI of Rs.20,000/- per month as agreed upon and refund the excess interest, penalty charges, and coerced payments collected so far by the 3rd respondent bank and restructure to loan in accordance with the RBI guidelines.

ORDER

The Writ Petition is filed seeking Writ of Mandamus to direct the first respondent to direct the 2 and 3 to restore the original EMI of Rs.20,000/- per month as agreed upon and refund the excess interest, penalty charges, and coerced payments collected so far by the 3rd respondent bank and restructure to loan in accordance with the RBI guidelines.

2. The learned counsel for the respondent No.3 would submit that the account has not been rendered Non Performing Asset. So far, the petitioner is servicing the loan. Further, concern of the petitioner will be addressed. 2/4
