Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to remove the endorsement "held over" in the revenue records qua the petitioner's property in Survey No.481/33, Kottur Revenue Village, Thirumayam Taluk, Pudukkottai District and to consequently restore the name of the petitioner in the said records within the time that may be stipulated by this Court.

ORDER

Heard both sides.

2.The petitioner's grievance is that the petition mentioned land has been endorsed as "held over" in the revenue records. It is well settled that only no claim has been received during settlement proceedings in respect of the land, it will be endorsed as "held over" land. Where there is patta, it cannot be a held over land. The petitioner has to enclose the copy of the rough patta issued in his favour. If the petitioner is enjoying patta the endorsement "held over" has to be removed. 3.The petitioner is permitted to give a representation in this regard before the second respondent. On receipt of the same, it shall be disposed as per law within a period of eight weeks thereafter. 4.This writ petition is disposed of accordingly. There shall be no order as to costs.
