Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For Bail in Crime No.447 of 2024 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioners, who arrayed as accused, were arrested and remanded to judicial 1/3
custody on 12.06.2024 for the offences punishable under sections 279, 294(b), 353, 307, 506(ii) IPC and 25(1A) of Arms Act, in Crime No.447 of 2024 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioners herein and other accused have abused the defacto complainant in filthy language and deter the public servant from discharging his public duty and attempted to commit murder of him and also threatened him with dire consequences. Hence, the compliant.
3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is in judicial custody for the past 58 days and seeks bail.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioners are habitual offenders and the A1 is having 16 previous cases and A2 is having 10 previous cases and hence, he strongly opposed to grant bail to the petitioners.
5. Considering the submission made by the learned Additional Public Prosecutor appearing for the respondent and also considering serious nature of allegations made against the petitioner, this Court is not inclined to grant bail to the petitioner.
