S.C.No.113 of 2019 on the file of Principal District and Sessions Court, Pudukkottai. For Petitioner : Mr.R.Sevugaraja For Respondent : Mr.M.Veerenthiran, Government Advocate.

O R D E R

The petitioner herein is one of the accused in Spl.S.C.No.113 of 2019 on the file of the Principal District and Sessions Court, Pudukkottai. Non bailable Warrant was issued against the petitioner and it is pending as on date. I was not inclined to show indulgence to the petitioner herein. But then, dismissal of this criminal original petition is not going to serve any purpose. The petitioner through his counsel gives an undertaking that even if the other accused do not cooperate, from his end there will be fullest cooperation in future. The petitioner gives a further undertaking that he will appear on all future hearings without any default and if he is not able to appear, he will be duly represented by his counsel. The said undertaking is recorded.

2. The next hearing date is 20.11.2021. The petitioner shall appear before the trial Court on 20.11.2021 and apply for recall of warrant. Considering the special circumstances prevailing in this case, the learned trial Judge is called upon the accept the petitioner's surrender and also recall the warrant on the same day.
