ORDER
The petitioner herein seeks a direction to the respondents to survey the land situated in Survey Nos.303/8, 4, 5, 6, 7B and 7C in E.Patherpettai Village, Thuraiyur Taluk, Trichy District, by considering his representation dated 07.10.2024.
2. Heard the arguments of Mr.N.Ananda Kumar, learned counsel appearing for the petitioner and Mr.M.Gangatharan, learned Government Advocate, who takes notice for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3. According to the petitioner, the subject properties were purchased by him under two sale deeds dated 05.03.1997 and 2/6
17.10.2005. Patta for the subject properties stands in the name of the petitioner and others in Patta Nos.3417, 3418, 1634, 3415, 3416 and 3418. The petitioner submitted an online application dated 30.05.2024 in application No.2024/0123/15/001375 seeking survey of the subject properties. The same has not been considered. Hence, the petitioner has come before this Court.
4. The learned Government Advocate appearing for the respondents would submit that the online application submitted by the petitioner dated 30.05.2024 will be considered on its own merits within the time stipulated by this Court.
5. It is seen from the records that in respect of some of the survey numbers, the petitioner is not an exclusive owner. He purchased the subject properties along with other person. Likewise in respect of Survey No.303/4, one Veeramalai name is also mentioned in Patta as co-pattadar.
6. In these circumstances, without expressing any opinion on the merits of the matter, the respondents 3 and 4 are directed to consider the 3/6
online application of the petitioner dated 30.05.2024 and pass final orders on its own merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, the above said Veeramalai, S/o.Vellaiyan, neighboring land owners and other interested parties.
7. With the above direction, this Writ Petition stands disposed of. No costs.
