ORDER : The Court Made the following order :- The learned Government Advocate (Crl. Side) appearing for the respondent police has submitted that during the pendency of this petition, First Information Report has been registered in Crime No.20 of 2019 under Sections 9 and 10 of Child Marriage Restraint Act, 1929 and Section 6 of Protection of Child from Sexual Offences Act, 2012, against the first petitioner and two others namely Chinraj and Panjavarnam. CRL OP(MD). No.11585 of 2019 to judicial custody and in so far as other petitioners are concerned, they are not arrayed as accused in the FIR and therefore, she prayed to dismiss the petition.
2.The learned counsel appearing for the petitioners has fairly conceded that after registering the FIR, the first petitioner has been arrested and remanded to judicial custody and in so far as other petitioners are concerned, they were not arrayed as accused. 3.A perusal of the FIR shows that the FIR has been registered against the first petitioner and two others namely Chinraj and Panjavarnam. Since the first petitioner has been arrested and remanded to judicial custody, this criminal original petition has become infructuous. Hence, in so far as the first petitioner is concerned, this Criminal original petition is dismissed as infructuous. In so far as other petitioners are concerned, they are not arrayed as accused.
