ORDER
Mr.Raguvaran Gopalan seeks permission of this Court to withdraw I.A.No.6 of 2024 in O.S.No.265 of 2013 on the file of the learned IV Additional Subordinate Judge at Tiruchirappalli itself. 2.As this revision arises out of a pending proceeding, the request of Mr.Raguvaran Gopalan is acceded to and he is permitted to withdraw I.A.No.6 of 2024 in O.S.No.265 of 2013. 3.The ground for dismissal of I.A.No.6 of 2024 was primarily that the schedule of property given in the plaint does not match with the schedule of property given in the application. This was on account of an error committed by the plaintiff in not filing the amended plaint. 4.Mr.Raguvaran Gopalan states that the amended plaint has been filed and a review petition has also been presented to review the order impugned in this revision. As I.A.No.6 of 2024 itself is being withdrawn, the necessity for the court to consider the review also does not arise. The change in circumstance of filing an amended plaint 2/4
entitles the civil revision petitioner to file a fresh application without the bar of res judicata.
5.With the above observations, the Civil Revision Petition stands dismissed as withdrawn. No costs. Consequently, connected Miscellaneous Petition is closed.
