ORDER : The Court made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 342, 406, 417, 498(A) and 506(1) of IPC and Section 4 of TNPWH Act, in Crime No.19 of 2014, on the file of the 1/4

respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the first accused had love affair with the defacto complainant and later he refused to marry her, the defacto complainant questioned the same. At that time, at the instance of the first accused, the petitioner abused the defacto complainant and also assaulted her. Hence, the complaint. 3.The learned counsel for the petitioner submits that the petitioner is an innocent and she has not committed any offence as alleged by the prosecution. He further submitted that first accused was arrested and thereafter, he was released on bail.

4. The learned Government Advocate(Crl.Side) appearing for the respondent submits that the final report has been filed before the Additional Mahila Court, Dindigul and the same was taken on file in C.C.No.55 of 2014. He further submitted that at the instance of the first accused, the petitioner abused the defacto complainant in filthy language and also threatened her.

5.Considering the facts and the circumstances of this case, considering the limited role that has been played by the petitioner and also the grant of anticipatory bail to the petitioner, this Court is inclined to grant anticipatory bail to the petitioner, however, with stringent conditions.

6.Accordingly, the petitioner is ordered to be released on bail in the event of 2/4

arrest or his appearance, before the learned Additional Mahila Court(Magistraterial Level), Dindigul, and on his executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only), with two sureties, each for a like sum to the satisfaction of the learned Magistrate concerned; and the petitioner shall appear before the respondent police on every Saturday at 10.30 am until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 7.The petitioner shall appear before the concerned Magistrate within a period of fifteen days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 18/07/2023 / TRUE COPY / /08/2023 Sub-Assistant Registrar (C.S.)
