For Respondent : Mr..P.Kottaichamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 482 BNSS PRAYER :- For Anticipatory Bail in Crime No. 61 of 2024 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent 1/5

police for the alleged offence punishable under Section 341, 294(b), 323, 506(i) of IPC in Crime No.61 of 2024, on the file of the respondent police, seeks anticipatory bail. 2.The allegation as against this petitioner is that the petitioner/son of the Village Panchayat President is said to have demanded bribe from a Lorry Transporter for taking the good through his Village. 3.Considering the nature of offence and the antecedents of this petitioner, this Court, by earlier order, dated 04.06.2024 has dismissed the application filed by this petitioner. Now, the petitioner has renewed his application on the ground that the petitioner has changed his attitude and in order to show his bonafide, he has donated 334 books worth about Rs.

50,000/- to the Chief Educational Officer, Pudukottai, for the purpose of Libraries at Government Schools in the District. A receipt, dated 12.08.2024 issued by the Chief Educational Officer, Pudukottai stating that the books donated by the petitioner herein, would be distributed to the Libraries of Government Schools at Surundapatti, Aaranipatti, Kulathur, Themmavur and Keeranur has also been placed before this Court. The learned counsel further submits that the petitioner is prepared to file an affidavit of undertaking that he will not indulge in any offence in future.

4.Considering the change in the attitude of the petitioner that he has realized his mistake and paid a sum of Rs.50,000/- to the Chief Educational Officer, Pudukottai, this Court is inclined to grant anticipatory bail to the petitioner. 5.Accordingly, this criminal original petition is allowed and the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the Judicial Magistrate Court, Keeranur, Pudukkottai District, on condition that the petitioner shall execute a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Keeranur, Pudukkottai District and on further conditions that:

i. The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the Government in proof of their residence address;

ii. The petitioner shall file an affidavit before the respondent police that he will not indulge in any offence in future.

iii. The petitioner shall appear before the respondent police daily at 10.30 a.m, until further orders.

iv. The petitioner shall not misuse the liberty granted to him by indulging in any further offence and shall not tamper with the prosecution witnesses. The petitioner shall be available for the trial as well. v. On violation of any of the above conditions by the petitioner, the respondent police shall move an application for cancellation of the anticipatory bail.

6.The Chief Educational Officer, Pudukottai shall distribute the books to the Libraries of Government Schools as stated in the receipt, dated 12.08.2024, forthwith.
