PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 3 to consider the representations dated 28.05.2023 submitted by the Hon'ble Administrator of the petitioner Yadhavar Kalvi Nidhi and issue patta to the petitioner for the lands measuring an extent of 39 acres and 57 cents, allotted by the Government of Tamil Nadu vide G.O.Ms.No. 2350 dated 24.07.1970, in survey numbers 6/13 and 6/17, located in Thiruppalai Village, Madurai North Taluk, Madurai District. This writ petition is filed for a Mandamus to direct the respondents 1 to 3 to issue patta to the petitioner for certain lands by considering his representation dated 28.05.2023. 2.When this writ petition was taken up for hearing on 21.09.2023, there was no representation for the petitioner. Hence, this writ petition was ordered to be listed on 25.09.2023. 2/6

3.This writ petition is filed pursuant to the request of the Honourable Administrator appointed for the administration of ''Yadavar Kalvi Nithi''. The Honourable Administrator has already conducted an election and new office bearers have been elected for the ''Yadavar Kalvi Nithi''. Therefore, they have handed over the papers along with NOC/consent for change of Vakalat in this instant writ petition on 18.09.2023. Therefore, they have requested to remove the name of the counsel. Hence, this Court directed the Registry to remove the name of the counsel and list this writ petition in the name of the petitioner Society under the caption ''for dismissal''.

4.The learned counsel for the petitioner has filed a memo stating that he has already issued a notice to the petitioner's Society mentioning the date of hearing of this writ petition. However, there is no representation for the petitioner Society even today.

5.The learned Additional Government Pleader appearing for the respondents has submitted a proceedings of the Tahsildar in Na.Ka.No.4784/2023/B1, dated 25.07.2023 that the respondents have already surveyed the land in S.No.6/17 and a patta has also been issued.

6.Considering the fact that there is no representation for the petitioner Society, this writ petition is dismissed for default. No costs.
