Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of Mandamus, directing the respondent herein to conduct an enquiry based on the petitioner's complaint dated 17.02.2025 and to complete the enquiry of the respondent in his proceedings in Na.Ka.No.785/E1/2025 taking into due consideration the written statement of the writ petitioner as well as members of the Thetchanathu Saiva Velalar Sangam at Perunazhi (Reg.No. 27/1984) on the file of the respondent within a stipulated time frame as fixed by this Court.

ORDER

This Writ Petition is filed for Mandamus to direct the respondent herein to conduct an enquiry based on the petitioner's complaint dated 17.02.2025 and to complete the enquiry of the respondent in his proceedings in Na.Ka.No. 785/E1/2025 taking into due consideration, the written statement of the writ petitioner as well as members of the Thetchanathu Saiva Velalar Sangam at Perunazhi (Reg.No.27/1984) on the file of the respondent within a stipulated time frame as fixed by this Court.

2. The petitioner has given a complaint against the office bearers of Thetchanathu Saiva Velalar Sangam at Perunazhi bearing Registration No.27/1984. It is the case of the petitioner that enquiry has also commenced. However, the respondent has not taken any meaningful steps for completing the enquiry and passing further orders pursuant to the aforesaid complaint/representation of the petitioner dated 17.02.2025.

On the other hand, the learned Additional Government Pleader for the respondent submits that pursuant to the complaint dated 17.02.2025, enquiry has commenced and the first hearing was held on 10.06.2025 and thereafter, on 18.06.2025. It is submitted that the office bearers of the aforesaid Sangam are taking time for production of records and the case has been adjourned and that enquiry will be completed as expeditiously as possible.

4. By way of rejoinder, the learned counsel for the petitioner submits that the attempt of the office bearers is to delay the enquiry so that they can continue to be in charge of the aforesaid Sangam till their tenure, which expires in October 2025.

5. The learned Additional Government Pleader for the respondent submits that it will take at least two months' time for orders to be passed pursuant to the enquiry.

Considering the above submissions made by the learned counsel for the petitioner and the respondent, this Writ Petition is disposed of by directing the respondent to complete the enquiry pursuant to the complaint dated 17.02.2025 as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order. In case the office bearers of the said Sangam are found to have committed any breach of the bylaws or law, appropriate action may be taken against them in accordance with law. There shall be no order as to costs.
