PRAYER :- For Bail in Crime No.159 of 2020 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/sole accused herein was arrested and remanded to Judicial Custody on 19.11.2020 for the offences punishable under Sections 6(4) of TNSC(RDCS)Order 1982 r/w. Section 7(1)(a)(ii) of Essential Commodities Act,1955.
2. The case of the prosecution is that the petitioner was found in illegal possession of 1025 Kgs of PDS rice.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in the above case. He would also submit that the PDS rice was recovered 4.The learned Government Advocate(Crl.Side) would submit that petitioner was found in illegal possession of 1025 Kgs of PDS rice.
5. Taking note of the above facts and circumstances of the case and also taking note of the fact that rice was recovered and also taking into consideration the period of incarceration, this 1/3
Court is inclined to grant bail to the petitioner subject to the following conditions.
6.Accordingly, the petitioner is ordered to be released on bail, subject to the following conditions:
[a] the petitioner is directed to contribute 10 bags of branded ponni rice (each 50 Kg), to the Annai Sathya Orphanage Home, Soolakarai, Virudhunagar without prejudice to his defence before the trial Court [b] On such contribution being made,the petitioner shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Virudhunagar [c] the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity;
[d] the petitioner shall report before the respondent police daily at 10.30 a.m until further orders.
[e]the petitioner shall not abscond either during investigation or trial.
[f]the petitioner shall not tamper with evidence or witness either during investigation or trial.
[g]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [h]If the accused thereafter absconds, a fresh FIR can be registered under Section 229A IPC.
