ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, learned Central Government Standing Counsel for the respondents 1 to 3 and learned Government Advocate (Crl.Side) for the fourth respondent.

2. This Writ Petition has been filed for a Mandamus to direct the respondents 2 and 3 to issue passport to the petitioner in response to the 2/5

application filed by the petitioner dated 14.04.2025 vide passport application No. (ARN). 25-1003559011.

3. The learned Government Advocate (Crl.Side) for the fourth respondent submits that an FIR has been registered against the petitioner in Crime No.207 of 2023 for the offences under Sections 147, 294(b), 323 and 506(i) of IPC.

4. It is further submitted that the charge sheet has been filed through Efiling before the Judicial Magistrate Court, Eraniel, Kanyakumari District on 19.06.2025.

5. Considering the same, there cannot be a positive direction to the respondents to hand over the passport to the petitioner. However, liberty is given to the petitioner to move a suitable application before the learned Judicial Magistrate, Eraniel, in connection with the issuance of the passport and in the background of the FIR registered against the petitioner in Crime No.207 of 2023 dated 06.11.2023, in respect of which the fourth respondent has filed charge sheet on 19.06.2025.

6. With the above liberty, this Writ Petition is dismissed. No costs. 3/5
