ORDER
In pursuance of the directions of this Court, the learned Subordinate Judge, Virudhunagar, submitted a report, dated 25.11.2025, stating that so far 59 Interlocutory petitions were filed out of which, 42 interlocutory petitions were filed by the plaintiff side and 17 interlocutory petitions were filed by the defendants side and that 57 petitions were already disposed of; that the 2/5
injunction petition filed by the plaintiff in I.A.No.52 of 2025 and another application filed under Order 16 Rule 1 and 2 of C.P.C., in I.A.No.53 of 2025 are pending. The learned Subordinate Judge has further stated that both the parties are responsible for the delay.
2. It is seen from the records that this Court while disposing the revision Petition in C.R.P.(MD)No.3379 of 2023 on 22.12.2023, directed the trial Court to complete the trial and dispose of the suit within a period of three months from the date of receipt of copy of that order and the said order came to be confirmed by the Hon'ble Supreme Court. Subsequently, time was extended and lastly time was extended till 17.12.2025. 3.It is not in dispute that the evidence of both sides were over and when the matter was pending for arguments, the applications now pending came to be filed. Taking note of the fact that nearly two years had lapsed, since issuance of direction by this Court, the learned Judge is directed to take necessary steps to dispose of the suit within the time granted ie., on or before 17.12.2025. Both parties are directed to co-operate for the completion of trial proceedings within the time stipulated by this Court. 3/5
4 .With the above direction, the Civil Miscellaneous Petition is disposed of.
