To pass order of Stay all further proceedings of the in E.P. No. 107 of 2021 in O.S. No. 57 of 2016 on the file of the Additional District and Session court (FTC) Judge, Theni till the final disposal of the Civil Revision Petition.
Prayer in CRP(MD).1355/2023 :
To call for the records the petition in sale proclamation and sale of housing property in survey No.1120/1F, 1120/G, and 1166/1 bearing Door No. 105/5 of Theni District on 12.06.2023 in E.P. No. 107 of 2021 in O.S. No. 57 of 2016 on the file of the Additional District and Session Court (FTC) Judge, Theni and to struck down the same and allow this Civil Revision Petition.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.S.ATHAM ALI, Advocate for the petitioner, the court made the following order:- This Court, by an order dated 12.06.2023, granted an interim stay of confirmation of sale subject to the petitioners depositing a https://www.mhc.tn.gov.in/judis 1/2
CMP(MD) No.8272 of 2023 sum of Rs.21,56,637/- in four equal installments and directed the petitioners to deposit 25% of the E.P. amount on or before 12.07.2023 and file a memo for compliance of the order on the next date of hearing, i.e. today.
2.But, today, the petitioners have filed this Civil Miscellaneous Petition praying for extension of time to deposit 25% of the E.P. amount. In the affidavit, the first petitioner has stated that due to the reason that the second petitioner who is the mother of the first and third petitioners fell in ill and bedridden, he could not mobilize the fund to deposit the amount and therefore prays for extension of time to deposit the amount as ordered by this Court in the order dated 12.06.2023.
3.Considering the above reasons, further one month time from today is granted to the petitioner to deposit 25% of the E.P. amount. Therefore, the interim order already granted by this Court is extended till 12.08.2023.
