For Respondent : Mr.R.Erottuchamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.575 of 2020 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners, who are arrayed as A1 & A2, apprehending arrest at the hands of the respondent police for the offence punishable under Section 379 IPC and Section 21(1) of Tamil Nadu Mines and Minerals (Development & Regulations) Act, 1957, in Crime No.575 of 2020, seeks anticipatory bail.

2.The case of the prosecution is that the petitioners said to have illegally transported one unit of river sand. Hence, a case has been registered.

3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent Police.

4.The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners are ready and willing to surrender before the concerned Court and prayed that bail petition may considered on the same day on merits in accordance with law.

5.Considering the request of the learned counsel appearing for the petitioner, this Criminal Original Petition is dismissed. However, if the petitioners surrender before the concerned Court and if any bail petition is filed by the petitioners, it may be considered on the same day on merits in accordance with law. 6.Accordingly, this Criminal Original Petition stands dismissed.
