Respondent/Complainant Prayer :- This petition filed under section 482 of Cr.P.C to direct the respondent police to file the final report in crime no.31 of 2018 on the file of the respondent police, within a stipulated time. ORDER:- This Petition coming up for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Thiru.P.Muthuvijayapandian, Advocate for the Petitioner and of Thiru.V.Neelakandan, Additional Public Prosecutor for the respondent, this Court made the following order: This petition has been filed to direct the respondent police to file the final report in Crime No.31 of 2018 on the file of the respondent police, within a stipulated time.
2.The grievance of the petitioner is that the FIR registered for the offences under Sections 406 and 420 IPC, is pending from 2018 onwards and though the respondent have stated before this Court on 25.11.2019 in the quash petition filed by the accused in Crl.OP (MD)No.19613/2018 that charge sheet has been filed before the Additional Mahila Court, Nagercoil, and it is pending for cognizance, now almost one year is over and the charge sheet is not yet numbered and the case is not posted for trial. 3.Perusal of record shows that on earlier occasion in a quash petition filed by the accused in Crl.O.P(MD)No.19613 of 2018, the learned Government Advocate(Crl.Side) had reported that after investigation, the respondent police laid charge sheet before the Additional Mahila Court, Nagercoil, and it is pending for cognizance and recording the said submission, this Court by order dated 25.11.2019 had dismissed the said petition as infructuous. Now alleging that the charge sheet has not been taken cognizance till date, the petitioner is before this Court.

4.Therefore, the learned Judge, Additional Mahila Court, Nagercoil, is directed to submit a report as to why the charge sheet in Crime No.31/2018 has not been taken on file till date. 5.Post the matter on 06.01.2021.
