Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, by directing the 5th Respondent to return back all the original educational Certificates in the light of the guidelines issued by the University Grants Commission by stipulating a time limit and pass such other or further orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice. The present Writ Petition has been filed seeking a Mandamus directing the fifth respondent to return all the original educational certificates of the 2/6
petitioner in the light of the guidelines issued by the University Grants Commission.
2. The learned counsel appearing for the petitioner submitted that the petitioner completed his 12th Standard and thereafter joined the fifth respondent College in August 2023 to pursue an Engineering course, after submitting all his original certificates. However, he discontinued the course during the first year and sought return of his original educational certificates. It is the grievance of the petitioner that the fifth respondent has not returned the certificates and has demanded a sum of Rs.67,000/-. Hence, the present Writ Petition.
3. The learned counsel appearing for the fifth respondent submitted that the petitioner is liable to pay the first-year fees amounting to Rs.67,000/-, and since the said amount has not been paid, the original certificates have not been returned.
4. The learned counsel for the petitioner further submitted that the petitioner belongs to a downtrodden community and hails from a very poor 3/6
background. Due to the fact that the Engineering course was conducted in English medium, he was unable to continue his studies.
5. Considering the facts and circumstances of the case, and upon instructions, the learned counsel for the petitioner submitted that the petitioner is willing to pay a sum of Rs.10,000/- to the fifth respondent. The learned counsel for the fifth respondent agreed, that upon receipt of the said sum of Rs.10,000/-, all the original educational certificates of the petitioner would be returned to him.
6. Recording the above said submission, this Writ Petition stands disposed of. No costs.
