India for issuance of Writ Mandamus, to direct the 1st respondent to take the petitioner Revision Case No. NIL of 2022 dated 04.07.2022 on file and to pass orders by direct the respondents 2 and 3 to disposed off the gratuity amount along with applicable interest as envisaged in the payment of gratuity act and as per the special bye-law of the 2nd and 3rd respondents bank by calculating the same from the date on which I had relieved from service (i.e) on 09.09.2019 to till the date of realization by considering the petitioner's representation dated 18.11.2019 , 31.01.2020 and 17.09.2020, within the period stipulated by this Court. ORDER

The petitioner herein, while serving as a Manager in the second respondent bank, had resigned from service, which was accepted by the third respondent on 09.09.2019 and accordingly, he was relieved from the service. Since the retirement benefits were not settled in time, the present writ petition has been filed, seeking for a direction to the second respondent herein, to settle the gratuity amount and the retirement benefits.

2. The learned Government Advocate, on instructions, from the second respondent herein submitted that if some time is granted, they would settle the benefits to the petitioner herein.

3. In view of the positive action taken by the second respondent to disburse the petitioner's gratuity, there shall be a direction to the respondents 2 and 3 herein to forthwith pass orders, settling the entire gratuity and other retirement benefits to the petitioner herein, within a period of two (2) weeks from the date of receipt of a copy of this order.

4. With the above direction, this Writ Petition is disposed of. No costs.
